The UT Administration has planned to demolish the last slum — Shahpur Colony in Sector 38 (West) — in the first week of October. After the demolition of this slum, Chandigarh will be declared the first slum-free city of India and development will be carried out according to its original Master Plan prepared by the Swiss-French architect Le Corbusier. According to officials, notices would be issued to the illegal occupants of Shahpur Colony next week. They will be asked to vacate the land at the earliest. The demolition drive was likely to be carried out after Dassehra on October 2, said the officials. The assertion came as a Division Bench held that war injury pension could not be denied once a soldier was invalidated out of service due to disability attributable to military service. Dismissing a writ petition filed by the Union of India against an order of the Armed Forces Tribunal, the Bench of Justice Harsimran Singh Sethi and Justice Vikas Suri made it clear that the very nature of posting in a counterinsurgency zone carried inher- WHY THE RULING MATTERS The ruling shuts the door on the Union’s attempt to deny war injury pension by drawing a distinction between “injury” and “disease.” By holding that “any disability suffered in an operational area amounts to war injury”, the High Court has expanded protection for soldiers and reinforced that the “risk of invalidation in such zones is inseparable from service itself”. ent risks, and any disability contracted therein must be treated as a war injury. “Once, the disease/injury suffered by an officer invalidates him/her out of service, the differentiation being created by the petitioner-Union of India between a disease suffered or the injury incurred to deny the benefit of war injury pension cannot be allowed,” the Bench held. On May 6, the Administration had removed nearly 2,500 structures at Janta Colony in Sector 25 and reclaimed around 10 acres of government land worth Rs 350 crore. On April 23, nearly 1,000 jhuggis were razed in Sanjay Colony, Industrial Area, Phase I. Chandigarh, September 10 A local court has sentenced a man to three-year rigorous imprisonment for allegedly forging an MBBS degree and registration certificate to take a loan to run a dialysis centre. The accused, Goswami Vishwa Bhushan Bharti, a resident of Sector 15 here, had also contested the Lok Sabha election from Chandigarh 15 years ago. The police registered the FIR against him on January 12, 2015, under Sections 420, 467, 468, 471 and 511 of the IPC at the Sector 3 police station on a complaint filed by a bank officer. The complainant had stated that the accused, raised a loan of Rs 12 lakh in the name of M/s Arbind Dialysis Centre, Chandigarh, which was sanctioned on January 20, .2014, through the loan processing cell of the State Bank of Patiala, Sector 8-C, Chandigarh. The bank verified the registration certificate issued by the Delhi Medical Council and found it to be fake. The bank authorities also came to know that the accused contested the LS election from Chandigarh seat in 2009. In his nomination papers, he declared his qualification as 12th pass. The complainant alleged that M/s Arbind Dialysis Centre had availed of the loan fraudulently by producing the forged documents. Finding a prima facie case, the court framed charges under Sections 420, 467, 468 and 471 of IPC against the accused, to which he pleaded not guilty. The public prosecutor said the prosecution had proved the case beyond a shadow of doubt. However, the accused denied the charges. He claimed that the proprietor of M/s Arbind Dialysis Centre, Bijay Kumar Chandra, has been examined and he proved on record that he availed of the loan facility and repaid the same and the accused was just a caretaker of the establishment. He did not cause any loss to the complainant bank. Upholding the order of the Armed Forces Tribunal granting 50 per cent war injury pension, the High Court asserted: “Once it has been conceded by the petitioners that the disease due to which respondent has been invalidated out of service is attributable to the military service as the same disease was suffered while being posted in the operational area, the benefit of war injury pension has rightly been granted.” The Court found no perversity in the Tribunal’s order, either on facts or in law, and dismissed the writ petition. “No ground is made out to interfere in the order passed by the Tribunal and the present writ petition is dismissed accordingly,” the Bench concluded. c m y b In the memorandum, Chandigarh BJP general secretary Ramveer Bhatti has stated that if the flyover is extended to start from the Chandigarh-Zirakpur barrier, passes over Sector 31-32 chowk and lands further ahead, it will significantly reduce the current traffic load and benefit daily commuters. current traffic load and benefit daily commuters.
