Rejecting their plea for adjournment, a Bench led by Justice Hemant Gupta issued a notice to the state government on petitions challenging the Karnataka High Court verdict upholding the ban on hijab in educational institutions in the state. Several petitions have been filed in the apex court against the Karnataka High Court’s March 15 verdict holding that wearing of hijab is not a part of the essential religious practice which can be protected under Article 25 of the Constitution. The high court had dismissed the petitions filed by a section of Muslim students from Government Pre-University Girls College in Udupi, seeking permission to wear hijab in the classroom. It upheld the ban on wearing hijab in educational institutions in the state, saying it was not an essential religious practice of Islam while school uniforms promoted harmony and spirit of common brotherhood. “We are of the considered opinion that wearing of hijab by Muslim women does not form a part of essential religious practice in Islamic faith,” the HC had said. New Delhi, August 29 With Justice UU Lalit taking over as the new Chief Justice of India, winds of change are blowing in the Supreme Court. On his first working day as the CJI, Justice Lalit announced that a new procedure for listing of urgent matters would be put in place by September 1. “We will have a new mechanism by Thursday. Till then, we will look at it in the chamber, and if urgent, we will list it…. This assumption ignores both, the many circumstances which may lead to a change in one’s familial structure, and the fact that many families do not conform to this expectation to begin with,” a Bench led by Justice DY Chandrachud said. “Familial relationships may take the form of domestic, unmarried partnerships or queer relationships. A household may be a single parent household for any number of reasons, including the death of a spouse, separation or divorce. The shepherds, who rear sheep and yak, graze their animals around the Indus river — Demchok is on its banks. The incident is learnt to have occurred on August 21 along the LAC and the military commanders of the two sides met on Tuesday, sources said. There was no face-off or confrontation between the Indian and Chinese forces, Army sources said, adding such incidents were a “routine”. The PLA troops raised objections despite the shepherds being on the Indian side of the LAC.
