The Opposition termed the report “biased and one-sided”. In the face of the protests, Home Minister Amit Shah assured the Lower House that the government had no objection if the dissent notes were included in the report without redaction. The minister left it to Speaker Om Birla’s discretion to take a call. The Lower House was later adjourned till March 10, marking the end of the first session of the Budget session. The committee, whose terms and conditions are to be formulated by Speaker Om Birla, will submit its report on the “first day of the next session”. However, it wasn’t made clear whether the “first day” was the beginning of the second part of the Budget session—first half ended on Thursday—on March 10 or when the monsoon session commences in August. The Bill, which will replace the Income Tax Act-1961, was introduced amid objections by Congress MP Manish Tewari, RSP’s NK Premachandran and TMC’s Sougata Roy. The decisions appeared aimed at wooing the youth, nearly 6 lakh government employees and pensioners, and the marginalised sections. The Cabinet also approved the establishment of special fasttrack courts to handle cases of NRIs, a crucial voter base for the AAP in Punjab. The courts are expected to be set up in Jalandhar, Kapurthala, Hoshiarpur, Nawanshahr, Ludhiana and Moga. Of the 60,000 posts to be filled, 2,000 would be in the Education Department, said a government spokesperson after the three-hour meeting, which was chaired by Chief Minister Bhagwant Mann. Though the next Punjab Assembly elections are still two years away, the Cabinet decisions suggest efforts to woo the electorate by promoting a “Punjab model of governance”. However, the cash-strapped government may struggle to generate resources to implement the populist steps. To gather funds for the housing scheme, the government aims continued on page 10 Art 370 was temporary provision meant to fade away: Ex-CJI Tribune News Service New Delhi, February 13 Former Chief Justice of India DY Chandrachud has defended the Supreme Court’s verdict upholding the abrogation of Article 370 of the Constitution, saying it was a temporary and transitional provision meant to fade away and the verdict had led to the restoration of democracy in Jammu and Kashmir. In an interview with the BBC Hardtalk programme, Justice Chandrachud said the Supreme Court acknowledged that if the elected gov- ernment decided to abrogate a provision meant to be transitional, it was acceptable. “Article 370 of the Constitution, when it was introduced…, was part of a chapter titled ‘transitional arrangements’ or ‘transitional provisions’. It was later renamed as ‘temporary and transitional provisions’, and, therefore, at the birth of the Constitution, the assumption was that what was transitional would have to fade away... In a unanimous verdict, a five-judge Constitution Bench led by CJI Chandrachud had on December 13, 2023, ruled that Article 370 of the Constitution was a temporary provision and the President had the power to abrogate the provision, which was an interim arrangement due to war conditions in the state. It had also directed the Election Commission to hold elections in the union territory of Jammu and Kashmir without waiting for the restoration of the statehood by September 30, 2024. Elections were held in Jammu and Kashmir in October last year. To a question on his alleged statement that he had asked God for a solution to the Ayodhya dispute, the former CJI said, “That’s completely erroneous…If you look at social media and try and derive what was said by a judge, you will get the wrong answer.” Justice Chandrachud said, “I make no bones of the fact that I am a man of faith, our continued on page 10
