INBRIEF 65 INTOXICATING TABLETS SEIZED Phagwara: The police have arrested a man after allegedly recovering 35 intoxicating tablets from him. The accused has been identified as Gursharan Singh of Nava Pind Naicha. The tablets were recovered from the accused during checking. The police have arrested a man after allegedly recovering 30 tablets.The accused has been identified as Prabhjot Singh of Lakhan Khurd, Kapurthala. OC BIKER DIES IN TRUCK ACCIDENT Phagwara: A man died after the motorcycle he was riding was allegedly hit by a truck near a factory on September 15. A case was registered on the complaint of Jaswinder Kaur of Mau Sahib village under Bilga police station. According to the complaint, Des Raj was travelling on a motorcycle when a truck allegedly being driven at a high speed collided with the motorcycle. He sustained serious injuries and later died. oc THREE BOOKED FOR HARASSMENT Phagwara: The police have registered a case against three persons following a complaint by a woman alleging domestic violence, financial exploitation and harassment after marriage. Following an inquiry, the police registered a case against Parmveer Singh, Santokh Singh and Baljinder Kaur of Sheikupur, Kapurthala. oc MAN DIES IN ROAD ACCIDENT Phagwara: The police have registered a case following the death of a man who sustained serious injuries in a road accident near Phagwara. Jaivir Singh of Bulandshahr in UP said his brother Yogender Singh was travelling from Ghaziabad towards Jammu when his vehicle was allegedly hit by a bus near Phagwara. He alleged that the bus was being driven rashly. Yogender Singh sustained serious injuries and later died. oc 112 LPG CYLINDERS RECOVERED Phagwara: The police have registered a case after allegedly recovering 112 LPG cylinders from a rented godown in the Sinpura area of Kapurthala. OC Kabaddi player is AAP Shahkot halqa in-charge Deepkamal Kaur Tribune News Service Jalandhar, September 17 The Aam Aadmi Party on Thursday appointed prominent kabaddi player Balvir Singh, more popular as Pala Jalalpuria, as the halqa incharge for Shahkot Assembly seat. He will be the third halqa in-charge of the party since the last elections. Hailing from Jalalpur village of Shahkot, Pala had been roped in by the party in April this year on the recommendation of local leader and Chairman, Punjab Khadi and Village Development Board, Kaku Ahluwalia. While his family is learnt to be settled in Canada, Pala has been staying back and getting active in local politics. In 2022, AAP had fielded Rattan Singh Kakar Kalan as its candidate, who remained on the third position despite the party’s wave at that time. Congress MLA Hardev S Laddi Sherowalia was re-elected. Kakar Kalan had died in December 2023 after illness. Prior to his death, Rana Hardeep Singh had become more active and was seen holding events for AAP in Shahkot Kabaddi player Pala Jalalpuria with CM Bhagwant Mann. He reportedly had blamed an officer from the CMO for illegal mining in the area, which was recorded and revealed to party higher-ups. Later, Pandori was made to issue a video statement seeking apology for the same. The party took just about two weeks to dump him and replace him with Pala Jalalpuria. Redevelopment of city rly station to begin soon Rishika Kriti Tribune News Service Our Correspondent Jalandhar, September 17 After the delay of nearly two years, the redevelopment of Jalandhar City railway station is set to begin within the next few weeks. The railways authorities have identified a structure near the Government Railway Police (GRP) station for demolition to make way for a new station building. As part of the preparatory work, the road near the structure has also been closed and traffic diverted. The Rs 219 crore redevelopment project was announced in February 2024 and was originally scheduled to be completed within 30 months. However, the construction could not begin as planned as the Railways had prioritised the revamp of Jalandhar Cantt railway station. With the renovation of the Cantt station now complete, the focus has now shifted to the city station. The redevelopment will be carried out in phases, with the first phase focusing on the main entrance and passenger facilities. The existing station building will be replaced with a new one, while the approach roads and circulating area outside the station will also be improved. A new 12-metre-wide foot overbridge will connect Platform 1 with Platforms 2 and 3. The existing foot overbridge will be dismantled while Kapurthala, September 17 Several houses in Preet Nagar of Kapurthala suffered a substantial damage after lightning struck the locality during heavy rain late Wednesday night. The incident reportedly damaged electrical and electronic appliances worth lakhs of rupees in seven houses, while cracks also developed in the walls of house of Gurpal Singh Billa Councillor, Ward No 36. According to residents, the lightning strike occurred around 2.30 am, accompanied by a deafening thunderclap. The impact was so intense that residents said it sounded like a bomb blast, leaving people in the locality frightened. Billa said the impact caused cracks in the walls of the house, with some portions of the walls reportedly splitting. Several electrical and electronic appliances in neighbouring houses were also damaged. Residents said appliances, including air conditioners, LED televisions, refrigerators and tullu pump motors, besides other household electrical equipment, were damaged. The incident triggered panic among residents, who rushed out of their houses after hearing the loud blastlike sound. The affected families have urged the district administration for financial assistance. In Kapurthala, 499 officers deployed to check stubble burning incidents Tribune News Service Jalandhar, September 17 As many as 364 nodal and 135 cluster officers will keep a watch on stubble burning incidents this harvest season in Kapurthala. DC Akash Bansal on Thursday said the district administration had chalked out a comprehensive strategy to prevent stubble burning during the upcoming paddy harvesting season, with emphasis on scientific crop residue management, effective field-level monitoring and extensive awareness among farmers. Chairing a meeting to review the preparedness for the paddy harvesting season, the DC said the administration was committed to ensuring maximum utilisation of in-situ and ex-situ crop residue management techniques and creating greater awareness among farmers about the environmental, health and agricultural consequences of stubble burning. The DC said 7.5 lakh metric tonnes of paddy stubble was expected to be generated in Kapurthala district during the season. Of this, around 2.70 lakh MT would be managed through in-situ methods, while nearly 4.80 lakh MT would be handled through ex-situ management. The remaining crop residue would be channelled for productive utilisation in brick kilns, boilers and other suitable applications, reducing the need for farmers to burn the residue in the fields. He said farmers had access to around 4,000 crop residue management machines through Custom Hiring Centres, cooperative societies and farmer groups. These include balers, rakes, super seeders, smart seeders, surface seeders, zero drills, RMB ploughs, Lightning strike damages appliances in 7 houses mulchers, straw choppers, super SMS, crop reapers, rotary slashers and tractors, among others. He said these machines would enable farmers to manage paddy residue scientifically and adopt suitable techniques for sowing the next crop without resorting to burning. The DC said nodal and cluster officers would be deployed to monitor villages and clusters. They would remain in regular contact with farmers, identify vulnerable areas and ensure timely intervention wherever there was a possibility of stubble burning. Boy abducted by 2 youths Tribune News Service VDCs formed day before BJP’s Nasha Mukt Yatras Jalandhar, September 17 A four-year-old boy was allegedly abducted from near Leather Complex in Basti Bawa Khel area this afternoon. Two persons riding a scooter kidnapped the child. Shanu, mother of the missing boy, said her son was playing with other kids in the locality when the scooterists abducted her son. She said other children playing with her son apprised her of the incident. Aatish Bhatia, ACP-West, Jalandhar, said information reached the Basti Bawa Khel police station around 2 pm. He said a case had been registered and immediate investigation had been initiated. Jalandhar, September 17 Just a day ahead of the launch of BJP’s four ‘Nasha Mukt Yatras’ across the state, Jalandhar DC Varjeet Walia and Commissioner of Police Satinder Singh announced the appointment of Village Defence Committees and Ward Defence Committees for the last leg of the government’s Yudh Nashian Virudh campaign. New teams for the four urban Assembly segments of Jalandhar — Jalandhar Central, Jalandhar Cantt, Jalandhar West and Jalandhar North — were announced. Along with the DC and CP Mayor , Vaneet Dhir, Doaba coordinator of the Nasha Mukti Morcha Atin Agnihotri and AAP halqa in-charge Rajwinder Kaur Thiara addressed a gathering and called upon the committee members to remain actively engaged with residents in their villages and wards. The meeting focused on strengthening the grassroots participation and intensifying efforts to curb the drug menace across the district. They further said in the last phase, the teams of Nasha Mukti Morcha would visit every village and ward to interact with residents, spread awareness and discuss progress in the fight against drugs. Look beyond the words, says HC Saurabh Malik Tribune News Service Chandigarh, September 17 The Punjab and Haryana High Court has held that a condition requiring a beneficiary to provide care to a senior citizen is essential for invoking Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, but its existence need not be determined solely from the use of particular words in the property transfer deed. The court said the condition has to be examined in the context of the transaction as a whole and established from the transfer document, pleadings, surrounding circumstances and material before the competent authority. “While the existence of a condition accompanying the transfer remains a necessary requirement for invoking Section 23(1), the same has to be examined in the context of the transaction as a whole and not by adopting an unduly technical approach confined merely to the use of particular words in the transfer document. The existence of such condition, however, must be established from the transfer document, the pleadings of the parties, the circumstances surrounding the transaction and the material brought before the competent authority,” Justice Kirti Singh ruled. Section 23(1) allows a Maintenance Tribunal to declare a property transfer, such as a gift deed, void if it was made by an elderly on the condition that the transferee would provide basic amenities and physical needs, and the transferee subsequently failed or refused to do so. The ruling is significant as it recognizes that an express written clause is not mandatory; the maintenance condition can be implied – among other things – from the circumstances and material before the competent authority. It means that the elderly parent cannot necessarily lose the protection of the law merely because the property deed does not expressly say that the child receiving it must provide care and maintenance. The condition can still be established from other things. The ruling came on a petition challenging the annulment of a transfer deed executed by a senior citizen in favour of his son. Jalandhar SDM had allowed the father’s petition under Section 23(1) and annulled the transfer deed dated July 21, 2017. The DC had subsequently dismissed the son’s appeal on February 28, 2023. c m y b Maintenance condition must be established from record Justice Kirti Singh first reaffirmed the statutory requirement. Section 23(1), it said, provided a remedy where a senior citizen transferred property subject to a condition that the transferee would provide “basic amenities and basic physical needs” and the transferee subsequently refused or failed to do so. The existence of that condition and its breach constituted the “statutory foundation” for exercising power under Section 23(1). Justice Kirti Singh observed that the transfer deed dated July 21, 2017, did not contain an express stipulation, in the statutory language, requiring the son to provide basic amenities and physical needs to his father. The recital that the parties were aware of the 2007 Act and the 2012 Rules could also not, by itself, constitute the statutory condition. “However, that is not the end of the matter,” the court said. Justice Kirti Singh noted the father had specifically pleaded before the competent authority that the property was transferred on the son’s assurance of taking care of his father and his wife and attend to their daily needs. The court noted that this was not a plea introduced subsequently but “constituted the very foundation of the proceedings initiated under Section 23(1)”. A compromise dated January 4, 2022, was also considered relevant because it recorded an undertaking concerning the “care, respect, love and affection” towards the father and his wife. On conciliation, the court held that Section 6(6) was enabling in nature. It permitted the Tribunal to refer a matter to a Conciliation Officer but did not make such reference an “indispensable precondition” for adjudication of every dispute under the Act. No prejudice from the absence of such reference had been demonstrated in the case, particularly since the parties had themselves entered into a compromise. The High Court also stressed the limited scope of its writ jurisdiction under Articles 226 and 227. It said the Court was not required to substitute its assessment of disputed facts for that of the statutory authorities “merely because another view may also be possible”. Ultimately, the Court did not find jurisdictional error, patent illegality, violation of natural justice or perversity warranting interference with the orders of the authorities below. It specifically held that the absence of an express statutory recital in the transfer deed “cannot, in the factual setting of the present case, be considered in isolation” from the father’s pleaded case and the material considered by the authorities. The court concluded that purposive interpretation of the beneficial legislation could not dispense with the statutory foundation of Section 23. In the present case, however, the authorities had proceeded on the basis of a specific case of transfer upon an assurance of care, followed by a finding that the assurance had not been honoured. The writ petition was consequently dismissed.
