The petitioner claimed that the alleged recipient expired on September 10, 2022, while the cheque was dated April 15, 2023. Taking up the matter, Justice Mahabir Singh Sindhu stayed the proceedings before a Dera Bassi court. The proceedings under Negotiable Instruments Act are initiated after the receiver is informed by the bank that the cheque issued in his name has been dishonored. He then sends a legal notice to the drawer or the person FACEBOOK/CHANDIGARHTRIBUNE Chandigarh not designated World Heritage City: Centre to Parliament Info given by minister in response to question posed by MP Manish Tewari Tribune News Service New Delhi/Chandigarh, Feb 3 The Centre today informed Parliament that the Union Territory of Chandigarh had not been designated as a World Heritage City, while the Chandigarh Capitol Complex was inscribed as a Transnational World Heritage Property in 2016 under the title “The Architectural Work of Le Corbusier, an Outstanding Contribution to the Modern Movement.” This information was given by Culture and Tourism Minister Gajendra Shekhawat in response to a starred question posed by Congress’ Chandigarh MP Manish Tewari during Question Hour in the Lok Sabha. Though Tewari did not ask the question during Question Hour, as all Opposition members were protesting in the well of the House on the issue of Maha Kumbh stampede in Prayagraj, the printed reply submitted by the ministry to his question said, “The Union Territory of Chandigarh City has not been designated as a World The Chandigarh Capitol Complex was termed as a Transnational World Heritage Property in 2016. These criterion include the concerned city should repre- sent a masterpiece of human creative genius; exhibit an important interchange of human values, over a span of time or within a cultural area of the world, on developments in architecture or technology, monumental arts, town-planning or landscape design; bear a unique or, at least, exceptional testimony to a cultural tradition or to a civilisation which is living or which has disappeared; and also the city should be an outstanding example of a type of building, architectural or technological ensemble or landscape which illustrates (a) significant stage(s) in human history. The city aiming for a heritage status should be an outstanding example of a traditional human settlement, land-use, or sea-use, which is representative of a culture (or cultures) or human interaction with the environment, especially when it has become vulnerable under the impact of irreversible change; and lastly, it should be directly or tangibly associated with continued on page 2 The suspects in custody of the police. Jagatpura clash: 3 held for attempt to murder Tribune News Service Mohali, February 3 The police have arrested three persons on the charges of attempt to murder, rioting, criminal intimidation and snatching in connection with the clash that took place in Guru Nanak Colony, Jagatpura, on Sunday afternoon. The suspects have been identified as Mohali resident Himmat Singh, Patran resident Jodh Singh and Jagatpura resident Akshay. A case under Sections 109, 115 (2), 126 (2), 351 (2), 304 and 3/5 of the BNS was registered at the Phase-11 police station today. The DSP (City-2), Harsimran Singh Bal, said, “The suspects were intimidating residents there and used to indulge in street crime. On the instructions of senior officials, we are acting strictly against street crime and drug peddlers.” Two persons were injured after swords were brandished and stones hurled at residents of Guru Nanak Colony, Jagatpura, after they objected to a group of youths allegedly selling drugs in the area on Sunday afternoon. While AAP councillors attended the meeting, those of the Congress gave it a miss. Municipal Commissioner Amit Kumar, Joint Commissioners Gurinder Singh Sodhi, Sumit Sihag and Shashi Vasundhara, and Superintending Engineer, Horticulture and Electricity, KP Singh, were also present in the meeting. In her brief speech, the Mayor expressed the need for a time-bound work by the Municipal Corporation. She requested all councillors and officers to call her for any Congress skips interaction kind of issues related to the MC and development works in their respective wards and departments. She said overall development was her priority and the pending works would be completed soon with the cooperation of the councillors and officials. Public participation to ensure the beautification of the city is necessary, she added. She said works related to Ward Development Funds should be taken up on priority. She said action would be taken against the official concerned for unattended work. The receiver or the payee initiates legal action against the drawer if the payment is still not made. Typically, this process is governed by Section 138 of the Negotiable Instruments Act. The petitioner or the drawer challenged the validity of the cheque, arguing that it could not be considered a valid negotiable instrument since the receiver had already passed away months earlier. Appearing on his behalf before Justice Sindhu’s Bench, advocates Pankaj Chandgothia and Mahi Sindhu contended that the bank should have rejected the cheque with the reason “payee/account holder expired” or “payee account not existing.” Instead, the bank marked it as “payment stopped by drawer”. “The bank should have returned the cheque as it is as the payee was dead. But it gave the reason of payment stopped by the drawer. The reason should have been “payee/account holder expired” “payee account not existing”. The payee had expired more than nine months ago, yet the bank is entertaining a cheque in his name and operating the account of a dead person,” the counsel added. The Bench was also told that the complaint was filed on August 31, 2023, almost a year after the person’s death. “Despite the fact that the payee of the cheque had already expired, his daughter, maliciously, presented the said cheque for clearance in a joint account she was holding with her father. She was obliged to inform the bank about his death on September 10, 2022. But she deliberately did not do so, in order to take undue advantage,” the counsel added. The Tribune, now published from Chandigarh, started publication on February 2, 1881, in Lahore (now in Pakistan). It was started by Sardar Dyal Singh Majithia, a public-spirited philanthropist, and is run by a trust comprising four eminent persons as trustees.
